All services provided by us may only be used for lawful purposes. This includes, but not limited to: copyrighted material, material we judge to be threatening or obscene, illegal pornography.
Examples of unacceptable material:

Ddos / Scanning Bots
Warez Sites
Pirated Software
Hate sites
Hack programs and archives
Copyright Material
Child Pornography
Phishing & scam sites
Game Hacks
3.) Zero Tolerance Spam Policy
We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and Spam. "Safe lists" and "double opting" will be treated as spam. Any user who sends out Spam will have their account terminated without notice.
We reserve the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion. We also reserve the right to make any such modifications in an emergency at our sole discretion.
We reserve the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of Hostingforyou.co.uk. All rights reserved.
4.) Payment Information
You agree that until and unless you notify Hostingforyou.co.uk of your desire to cancel any or all services received, those services will be billed on a recurring basis and should be paid within the 7 days of notification. If you wish to cancel please contact our billing department. billing@hostingforyou.co.uk. Refunds will not be granted unless agreed by Hostingforyou.co.uk.
We reserve the right to change the monthly payment amount and any other charges at anytime.
If payment is not paid on time we have the right to remove any of the contents on your account, and will not be liable for any loss of content or income.
5.) Late Payments
All invoices must be paid within 7 days (Including non working) of them being sent. Your account will be suspended on the 8th day after the invoice(s) were sent if no payment has been received, upon your services being suspended you will have a further 7 days to pay the invoice(s) in full and will be charged a late payment fee of up 12% of your total arrears.
If we receive no payment or contact from you within the allocated 7 days your account will be terminated and a letter of final demand for payment will be sent to you, If we do not receive any payment or contact from you within 5 working days of the letter being sent your information will be passed to our debt recovery agency this may affect your credit rating making it hard for you to find credit in the future, failure to pay the agency may result in legal proceedings being taken against you.
6.) Sign-up Discounts
Any discount given at the sign-up process to any of Hostingforyou.co.uk's services can only be used for that sign-up, and can not be used in conjunction with any other service you may purchase.
Should you choose to extend your service plan (I.E. extend plan from monthly payments to annual payments) discount prices will not apply and you must pay the normal charge for your service.
We reserve the right to change the amount of discount for any service at any time with or without notice.
7.) Backups and Data Loss
Your use of the service is at your sole risk. We are not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backups of files and data stored on our servers.
Our servers are backed up on a daily basis. We take no responsibility for loss of your data if our backups fail.
8.) Cancellation and Refunds
All payments to Hostingforyou.co.uk are non-refundable unless otherwise stated by a member of the management team and include any applicable set-up fees and subsequent charges regardless of usage. All overcharges or billing disputes must be reported within 14 days of the time that the dispute occurred. If you dispute a charge to your credit card issuer that, in Hostingforyou.co.uk sole discretion, is a valid charge under the provisions of this Agreement, you agree to pay Hostingforyou.co.uk an additional "Investigation Fee" of £80. Any Cancellations must be reported to Hostingforyou.co.uk before the next recurring charge is due, failure to do so does not entitle you to a refund for the next recurring charge taken.
9.) Resource Usage
Users may not initiate the following:
a) Use 15% or more of system resources for longer then 120 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP etc.
b) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
c) Attempt to modify any services that will provide increased capacity for the customer. This includes all types of media broadcasting, web hosting and any other service that is supplied by Hostingforyou.co.uk.
Any user found to be abusing the service will be terminated without prior notice.
10.) Bandwidth Usage
You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month. Additional bandwidth is charged at £0.75 pence per 1GB.
11.) Money Back Guarantee
If for whatever reason you are unsatisfied with the service(s) you are being provided you are entitled to our 14 day money back guarantee with the following exceptions:
a) If you purchased a domain with your hosting package, you receive money for only the hosting package.
b) Domains are NON-refundable.
c) After 7 days of purchasing a service, refunds are at the discretion of Hostingforyou.co.uk and are subject to a written reason of why you seek a refund being sent to us.
d) We refund only the amount we gained AFTER administration charges (I.E. Bank charges and Paypal fees).
e) Refunds do not apply to dedicated servers
12.) Indemnification
Customer agrees that it shall defend, indemnify, save and hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against us, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless any liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with us; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from Hostingforyou.co.uk's server(s).
13.) Disclaimer
We will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We disclaim any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by our employees and us.
Hostingforyou.co.uk is provided on an "as is," "as available" basis without warranties of any kind, either expressed or implied, including but not limited to warranties of title or implied warranties of merchantability or fitness for a particular purpose. No oral advice or written information given by Hostingforyou.co.uk nor its affiliates, nor any of its officers, directors, employees, agents, providers, merchants, sponsors, licensers, or the like, shall create a warranty; nor shall you rely on any such information or advice.
Under no circumstances shall Hostingforyou.co.uk or any other party involved in creating, producing, or distributing Hostingforyou.co.uk be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of or inability to use Hostingforyou.co.uk, including but not limited to reliance by you on any information obtained from Hostingforyou.co.uk or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not resulting from acts of God, communications failure, theft, destruction, or unauthorized access to Hostingforyou.co.uk records, programs, or services. You hereby acknowledge that this paragraph shall apply to all content, merchandise, and services available through Hostingforyou.co.uk.
14.) Data Protection Act
The Data Protection Act requires Hostingforyou.co.uk and all clients must comply with a number of important principles regarding privacy and disclosure.
Hostingforyou.co.uk and all clients whom handle personal information must comply with eight principles of the data protection act.
Fairly and lawfully processed
Processed for limited purposes
Adequate, relevant and not excessive
Accurate and up to date
Not kept for longer than is necessary
Processed in line with individuals' rights
Secure
Not transferred to other countries without adequate protection

15.) E-mails
As of the 15th January 2007 all e-mails sent to any hostingforyou.co.uk e-mail account will be printed out and kept for reference and training purposes. These e-mails will be kept secure and will be accessible by selected Hostingforyou.co.uk employees only.
Hostingforyou.co.uk will NEVER sell or show these e-mails to any 3rd party company or any member of staff that does that have permission to view them, when Hostingforyou.co.uk use the e-mails for training any member of staff who views these e-mails will sign an agreement that they will not share any information that they view any violation of that agreement will result in immediate dismissal and the appropriate action being taken.
16.) Free Gifts
Should you take up a services from Hostingforyou.co.uk that includes a free gift you shall have no control over the model of the gift advertised. We have the right not to send your gift with or without reason.
Model's vary and are sent from what is available in stock at the time of order, you should allow 28 days for delivery of the item before contacting us about its whereabouts.
17.) Changes to the ToS
We reserve the right to revise its policies and pricing at any time with or without notice. Should the ToS change you have 7 days to read through the changes to ensure you are not violating any new terms. If found violating any terms regardless of if you did not read the ToS your account will be suspended or terminated depending on what and/or how many terms were violated.
IRC is allowed on our dedicated servers. Adult legal content is allowed on our shared unmetered US servers.
Proxies are allowed, but each incident of abuse carries a $9.99 abuse fee. The same goes for spam complaints.
A DDoS attack either outgoing from your server or coming in to your server implies a $79.99 damage fee.
SNMP must be left enabled at all times to properly allow bandwidth tracking. If a client disables SNMP on their server, they are subject to a fine of $29.
If an invoice is unpaid, we reserve the right to add a $50 handling fee as well as a $50 collections fee.
